Aree idonee, region by region

The national framework changed with Law 4/2026, and the regions are legislating at very different speeds. This page brings the state of implementation together in one place, with each region's act and official source, and says openly where the research is not yet complete.

The national framework

Law no. 4 of 15 January 2026 (Gazzetta Ufficiale no. 15 of 20 January 2026) converts Decree-Law 175/2025 and moves the aree idonee rules into articles 11-bis and following of Legislative Decree 190/2024. The conversion has been in force since 21 January 2026. Anyone still relying only on the Ministerial Decree of 21 June 2024 or on Legislative Decree 199/2021 is therefore working on an outdated framework.

For agricultural land, the national framework ties additional regional aree idonee to a share of between 0.8 and 3 per cent of the utilised agricultural area (SAU), with counting rules and municipal limiting powers set by article 11-bis(4)(g) and (h). This is, however, a criterion for regional designation. It is not a right to use the land, nor a universal 3 per cent cap that applies to every parcel.

The PAS threshold is 12 MW, not 10

Many summaries in circulation still get this wrong. Annex B of Legislative Decree 190/2024, in the text in force from 21 February 2026 and reproduced in the coordinated text of April 2026 in the Gazzetta Ufficiale, places photovoltaics below 12 MW in aree idonee and acceleration zones under the PAS. The threshold is strict: below 12 MW, not up to 12 MW. Summaries that cite 10 MW are out of date.

There is also a separate branch. Annex B allows the PAS for ground-mounted photovoltaics from 5 MW up to 15 MW in industrial, commercial and craft zones, and in closed landfills and quarries that meet the requirements. So there is no single capacity boundary that holds across Italy.

Where implementation stands, region by region

The columns keep apart three facts that do not coincide: adoption, publication and entry into force. Nine regional laws have been verified against the original. For the others, the row says where the process really stands, whether that is a proposal in committee, a text approved but not yet published, or research that established nothing. The status below is as verified against the original sources on 5 October 2026, with the Liguria, Sicily and Friuli Venezia Giulia rows updated on 20 October 2026. Not established in this research does not mean not published.

Three examples from the verified texts

Lombardy, Regional Law 10/2026, art. 2(2): additional aree idonee on agricultural land «non sono superiori allo 0,8 per cento della SAU dell'intero territorio regionale» (may not exceed 0.8 per cent of the utilised agricultural area of the whole region). The law also sets a municipal limit of 3 per cent and a provincial one of 2 per cent, with exceptions, and the count also covers electrochemical storage.

Emilia-Romagna, Regional Law 5/2026, art. 3(1)(a): «le aree racchiuse in un perimetro i cui punti distino non più di cento metri dai siti oggetto di bonifica» are suitable (areas within a perimeter whose points lie no more than one hundred metres from sites under remediation), with the availability conditions on the applicant and the exclusion of whoever is responsible for the contamination. Letter (b) uses 50 metres around data centres and SII plants, but only for self-consumption. Article 1(3) states expressly that suitability does not confer a right to install.

Sardinia is the case worth reading in full. Regional Law no. 20 of 5 December 2024, amended by Regional Law no. 31 of 6 November 2025, remains in force, but the Constitutional Court annulled parts of it in judgments 184/2025 and 144/2026. In judgment 156/2026, filed on 1 October 2026, it found the questions raised by TAR Lazio on the same law inadmissible or unfounded. A published act that is still in force can therefore contain provisions that no longer operate. That is why this page distinguishes between a verified law and a usable criterion.

How MitOS keeps track of all this

MitOS, by Ariadne Labs, derives the permitting route from the project's own data: technology, capacity, location and constraints. Change the region or the capacity, and the administrative branch and the deadlines are recalculated, with each requirement carrying the legal reference it comes from. So when a region publishes its act, you see at once which projects it affects.

Frequently asked questions

What is the PAS capacity threshold in aree idonee?

Below 12 MW under Annex B of Legislative Decree 190/2024, in the text in force from 21 February 2026. Summaries giving 10 MW are out of date. There is a separate branch from 5 to 15 MW for industrial, commercial and craft zones, and for qualifying closed landfills and quarries.

Is 3 per cent of the SAU a limit that applies everywhere?

No. The range between 0.8 and 3 per cent is a criterion for the regional designation of additional agricultural areas, not a universal cap that applies to every parcel.

If a region does not appear as published, does that mean it has not legislated?

No. It means this research did not establish publication at the date shown. Adoption, publication and entry into force are separate facts.

Does being in an area idonea give a right to build?

No. Emilia-Romagna's Regional Law 5/2026 says so expressly in article 1(3), and the principle holds generally: suitability concerns location. It does not replace the authorization, nor the environmental and landscape assessments.

What changed

Sources

This page summarises provisions for information and does not replace legal or technical advice on a specific project. The national provisions and the regional laws cited were verified against the original on 5 October 2026; the Liguria, Sicily and Friuli Venezia Giulia rows were updated on 20 October 2026. The regional matrix is openly partial: the existence of a regional act does not prove that all its criteria remain operative after the national reform or after litigation. Only the official publication is authoritative.

Permitting energy projects is a labyrinth. MitOS is the thread.
